Probation period in India gives you real flexibility when you write the rules yourself

Probation period in India is governed mostly by your employment contract, not by one national law. No single statute fixes a universal length, so the number you write into the offer letter carries real weight.

That’s good news if you plan for it. You can pick a period that fits the role. You can set clear notice terms. And you can confirm or extend on your own timetable. But loose drafting costs you, because any ambiguity in the clause is yours to answer for.

Probation period in India has no single national cap

You’ll see guides quote a flat six or twelve months as if it were national law. It isn’t. Those figures come from contracts and from standing orders, and they differ by state and by type of establishment.

In practice, three layers decide your position. The table below shows what each one controls.

The contract is the layer you control. The other three set the boundaries around it.

Standing orders can quietly override your assumptions

Where standing orders apply, they can cap probation and confirm an employee automatically. The Tamil Nadu schedule is a useful example. The schedule allows three months for unskilled workers and six months for others. It permits an extension of equal length. It also treats probation as satisfactorily completed if the employer doesn’t give written notice a week before it ends.

That last rule catches people out. An employer who forgets a calendar reminder can confirm someone by default.

The wider rulebook is also moving. The four labour codes took effect on 21 November 2025, according to the Press Information Bureau. DLA Piper’s tracking reports that standing orders now attach to industrial establishments with 300 or more workers, up from 100. It also notes that central and some state rules were still being finalised in early 2026. Existing provisions continue meanwhile, so confirm the current position for your state before you finalise any template.

What still applies from day one of probation

Probation doesn’t pause statutory obligations. Provident Fund and Employees’ State Insurance apply from the first day where the wage thresholds are met. TDS runs through payroll as normal.

Maternity protection depends on qualifying service, not on confirmation status, so a probationer isn’t automatically outside it. Our guide to maternity, paternity and parental leave in India covers the conditions in detail.

Gratuity works the same way. Your probation months count toward continuous service, so the clock starts at joining, not at confirmation. And the labour codes now require a written appointment letter for new hires, per the same PIB release. The contract therefore has to exist before day one.

Probation is not a fixed-term contract, and mixing them up costs money

Some employers try to solve performance risk by hiring on short fixed-term contracts and renewing them. That’s a different tool with different consequences.

Under the labour codes, fixed-term employees receive benefits on par with permanent staff. They also become eligible for gratuity after one year of service, rather than five, according to the PIB release. So a rolling fixed-term contract doesn’t avoid the cost you were trying to avoid.

Probation, by contrast, sits inside a permanent employment relationship. It’s a trial period with a defined end and a defined decision. Use it when you genuinely want to assess fit, and use fixed-term contracts only when the work itself has an end date.

How to structure a probation period in India in your contract

Treat the clause as a small system with four parts. If any part is missing, the others get weaker.

Length. In our experience, three to six months is common for most roles, with the upper end used for senior or specialist hires. Match it to how long it truly takes to judge performance, not to a template you inherited. If a standing order applies to you, stay inside its limit.

Extension. Write down who can extend, for how long, and how they must say so. Require written notice before the original end date, and cap the total. Never let probation roll on silently, because silence is the most common route to a confirmation dispute.

Notice during probation. State it outright. Many employers use a shorter notice period during probation than after confirmation. There’s no universal statutory figure, though, so the contract is what counts. Blank space here invites argument.

Confirmation. Say what happens at the end. Will you issue a written confirmation letter, and what’s the default if you don’t? Then schedule reviews at, say, 30, 60 and 90 days, and keep the notes. Those records are your evidence if anyone questions the outcome.

Ending or extending probation without creating a dispute

Consider a company that hires an analyst on a six-month probation, holds no reviews, and then decides in month five that the fit isn’t right. The employee has never seen written feedback. The exit may still be lawful. But the company has nothing on file to show a fair process, so every question becomes a negotiation.

Now change one thing. The same company held three short reviews, wrote down the gaps, and offered a one-time extension with a clear target. Whatever happens next, the paper trail tells a consistent story.
